The information here, in combination with Prizes and Prize values as listed on PirateGame.ca, constitute the Contest Particulars for the "Shiver Me Frosters" Pirate Battle Game contest. You must have a MyMacs.ca account to play. See Contest Rules and Regulations below for a full set of Rules and Regulations, which are incorporated here by reference.

PLAY TO WIN! In order to join the online "Shiver Me Frosters®" Pirate Battle Game, visit a Mac's Convenience Store. Receive one game ticket for every $5.00 in purchases, excluding lottery. Play online: Visit MyMacs.ca to register and enter the code from the game ticket to play the Shiver Me Frosters® Pirate Battle Game for the prizes as presented. Each game ticket has a different code number. Players can redeem an unlimited number of codes per day. Proof of purchase may be required when more than 20 codes are redeemed in a single day or when more than 100 codes are redeemed in a single week. There are many different ways to win.

Membership is open only to legal residents in the provinces of BC, AB, SK, MB and NWT who are 13 years of age or older who fulfill the requirements of registration. The following are the Official Rules and Regulations (the "Rules) of the Mac's Convenience Stores Inc. ("Mac's") Shiver Me Frosters® Contest Program (the "Program"). This is a program of the Western Division of Mac's Convenience Stores Inc., a subsidiary of Alimentation Couche-Tard Inc. (the "Primary Sponsor").

This Program is void, in whole or part, where prohibited by law and is subject to all Federal, Provincial and Municipal Laws and Regulations. Mac's Convenience Stores Inc. promotional group (the "Promotion Group") reserves the right to make changes to the Program, where necessary, due to changing business, operational and marketing considerations. There is no purchase necessary to participate in this promotion.

Subject to the applicable laws, these Rules govern all aspects of the Program and Contest Particulars and related Contests, and are binding upon all Participants. In the event of any inconsistency between the Rules and the conditions and explanations appearing on any other documents, including Contest Particulars, these Rules shall take precedence.

General Program Membership is open only to legal residents of British Columbia, Alberta, Saskatchewan, Manitoba and North West Territories who are 13 years of age or older who fulfill the requirements of registration. There will be no exceptions, and winners may be required to prove their age at the time of redeeming their prizes.

Members and associates of the "Promotion Group" are not eligible to win any of the Prizes. This includes: store operators, employees, officers, or immediate family members of Mac's Convenience Stores Inc. (including independent Mac's or Winks), 612 Creative, Alimentation Couche-Tard Inc., (collectively referred in the Rules as the "Sponsors") and each of their respective advertising agencies.

In order to participate in the on-line Program, you must have a valid e-mail address registered in your name and properly registered a MyMacs.ca "Account". See the MyMacs.ca Website Terms and Conditions for additional information on registering a MyMacs.ca "Account". In the event of a dispute regarding who submitted an on-line entry, the entry will be deemed submitted by the holder of the e-mail account.

Each Program will commence and end (the "Contest Period") - based on each province's applicable time zone and as detailed on the "Contest Particulars" presented with each Program offered. The "Contest Particulars" are incorporated into these Rules and Regulations and are to be interpreted together. Unless otherwise specified in the Contest Particulars, prizes will be delivered to winners at the address submitted within four (4) to six (6) weeks of receipt by the Fulfillment Department.

There are many different ways to win. Please refer to the Contest Particulars on PirateGame.ca or contest website for instructions on how to enter. You must clearly identify which Program you are participating in as presented on the Contest Particulars. There is no purchase necessary to participate in a Program. To request a contest entry without purchase please send you request, including the name of the contest, with a stamped, self addressed envelope to:

SKILL-TESTING REQUIREMENT: The skill-testing question as present on the "Contest Particulars" must be answered correctly in order to win.

PRIZES: Are as presented on each Program Contest Particulars.

Conditions: Indicated prizes will be awarded while supplies last. The Primary Sponsor reserves the right to substitute a prize of approximately equal value. A promotional prize offering cannot be combined with any other offer.

SELCTION OF WINNERS: Winners will be assigned based on scores (points earned) during the specified period for a given prize as identified in the Contest Particulars as reported by the PirateGame.ca website. Any attempt to manipulate or tamper with the contest scoring system will result in disqualification and possible criminal prosecution.

MyMacs.ca Members with Accounts are eligible (based on Program conditions and requirements) to win Prizes as presented on each Contest Particulars.

Prize packages will be posted online at PirateGame.ca in each Contest Particulars. Prizes are awarded only with the Program the Contest Praticulars state they are connected with. All indicated prizes are potential items in the prize pool and the Promotion Group reserves the right to substitute prizes of approximately equal value during the Contest Period or at the time of prize redemption and awarding. Only one prize can be awarded per Member/entrant within the same 45 day period, unless otherwise indicated in the contest particulars. The Promotion Group also reserves the right to modify any other awards, discounts, associated quantities and award schedules at any time during the Program.

The odds of "winning" will vary and change throughout the Contest Period depending on the number of Members who register an Account, the number of people participating in the Program and the number of prizes offered during a particular period of contest.

Prizes: Winners will be contacted by telephone and/or return e-mail and requested to fill out and return/fax a supplied prize redemption form. If a winner cannot be contacted within five (5) business days, or if a winner does not meet all of the rules and conditions or entry, another entry will be selected from the remaining eligible entries. Winners must answer the skill-testing question correctly and as presented on the Contest Particulars to receive the prize. The Promotion Group reserves the right to verify the authenticity of any winner's membership and Account before awarding any prizes. Winners must fill out their correct name and correct Particulars, prizes will be delivered to winners at the address submitted within four (4) to six (6) weeks of receipt by the Fulfillment Department.

The Fulfillment Department, Promotion Group and/or the Sponsors are not responsible for misdirected or lost mail, or mail that is tampered with. Please ensure that you are using a reliable method of mail to submit your supplied form to the Fulfillment Department.

Prizes must be acceped as awarded and cannot be transferred, substituted or redeemed for cash. The Promoion Group reserves the right, in their sole discretion to substitute any and all of the prizes for prizes of approximate equal value.

Winners may be required to complete and sign a Prize Affidavit and an Eligibility Release form in order to obtain their prize, which among other things may require proof of age and relationship to the Promotion Group if any.

By participating in the Program, entrants, guardians of minors, if winners, consent to the use of their names, cities of residence, photographs and /or images on video tape for publicity purposes in all media carried out by Mac;s Convenience Stores Inc., and the Promotion Group or by the Sponsors without payment or compensation or liability for use of the same.

Mac's Convenience Stores Inc. and the Promotion Group commit themselves to collect and use the Personal Information Requested from Prize winners, such as your name, address, telephone number, e-mail address and cell phone number in regard to the Program, solely and exclusively for:
a) the purposes of prize redemption and delivering the prize to you as provided for in the Rules;
and
b) in the case of Mac's Convenience Stores Inc., to promote and to market additional products and services offered by Mac's Convenience Stores Inc. and the Promotions Group.

You may, at any time, refuse or withdraw your consent under (b) prior to redeeming a prize. Mac's Convenience Stores Inc. and the Promotion Group will never use, rent , sell or otherwise communicate or give out your Personal Information to any other person without your prior consent, which you may refuse or withdraw at any time. By participating in a Program, you release Mac's Convenience Stores Inc. and the Promotion Group from any and all liability arising out of, pursuant to, or as a result of the carrying out of a Program, including liability arising from the acceptance of, and partcipation in a Program prize draw as awarded and confirming compliance with the Rules.

Mac's Convenience Stores Inc. and the Promotion Group are not responsible for contacting or forwarding prizes to winners who leave unclear or incomplete information, or for entries lost, misdirected, delayed or destroyed while in transit from the Sponsors' premises. All prize claim and related forms become the property of Mac's Convenience Stores Inc.

Mac's Convenience Stores Inc. reserves the right, in its sole discretion to cancel or suspend a Program, which includes Contest Particulars, or portions of a Program, in the case of tampering, fraud, equipment failure, security breaches or other causes beyond the reasonable control of Mac's Convenience Stores Inc. and the Promotion Group. Any attempt to deliberately damage or tamper with a Program, interfere with the proper administration of the Program or undermine the legitimate operation of a Program is a violation of criminal and civil laws, and should such an attempt be made, Mac's Convenience Stores Inc. and the Promotion Group reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Prize claims are subject to verification and will be declared invalid if they are illegible, mechanically reproduced, forged, falsified, altered or tampered with in any way.

In the unfortunate event the MyMacs.ca and/or PirateGame.ca websites either crash or experience technical difficulties, Mac's Convenience Stores Inc. and the Promotion Group are not responsible.
